1. Introduction
1.1 Legal Agreement
This document, which may also be referred to as "User Agreement" or "Agreement" throughout, constitutes a legally binding agreement between individuals, businesses, and organizations (collectively referred to as "Users") and Camspinchat, operating through www.camspinchat.com (which may also be referred to as the "Website" or "Web-site" hereafter) and the Camspinchat mobile application (which may also be referred to as the "App" or "Application" hereafter). Both platforms together may be referred to as "Services" throughout this agreement. This Agreement governs your access to and use of all Services provided by Camspinchat, including but not limited to video chat functionality, messaging features, user profiles, and any other features or functionalities made available through the Website or Application. By accessing or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by all the terms and conditions set forth in this Agreement.
1.2 Terms Definitions
For the purposes of this Agreement, the following definitions shall apply: The terms "us", "We", "our", and "ours" may be used interchangeably to refer to Camspinchat, its affiliates, subsidiaries, officers, directors, employees, agents, and representatives. The terms "you", "your", "User", "Visitor", and "Member" may be used to refer to all users, visitors, and members of Camspinchat Services, whether registered or unregistered. The terms "Content" and "Contents" are used to refer to any and all materials, information, data, text, images, videos, audio, messages, communications, profiles, or any other form of content made available, uploaded, transmitted, or shared via Camspinchat Services. "Chat Rules" refers to the community guidelines and behavioral standards established by Camspinchat for user conduct. "Personal Data" refers to any information relating to an identified or identifiable natural person as defined in our Privacy Policy.
1.3 Age Requirement
To access and use all services provided by Camspinchat, you must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater. By accessing or using our Services, you represent and warrant that you meet these age requirements. You confirm that you have the legal capacity to enter into this binding Agreement and that you are not prohibited by law from accessing or using our Services. Camspinchat reserves the right to request proof of age at any time and may suspend or terminate accounts that cannot provide adequate verification. We take the protection of minors seriously and will cooperate with law enforcement authorities regarding any suspected violations of age requirements. If we become aware that a user is under the minimum age requirement, we will immediately terminate their account and delete all associated personal information in accordance with applicable laws. Parents and guardians are responsible for monitoring and supervising the online activities of minors under their care and should ensure that minors do not access or use our Services.
1.4 Agreement Acceptance
By accessing, browsing, registering for, or using any portion of our Services, you expressly acknowledge that you have read, understood, and agree to be bound by all the terms and conditions set forth in this User Agreement. You also confirm that you have read, understood, and agree to our Privacy Policy, which is incorporated into this Agreement by reference. Your continued use of our Services constitutes ongoing acceptance of this Agreement and any modifications made to it. If you do not agree to all the terms and conditions of this Agreement, you must immediately cease using our Services. This Agreement supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, between you and Camspinchat regarding the subject matter contained herein. Your use of our Services is also subject to all applicable local, state, national, and international laws and regulations, and you agree to comply with all such laws in your use of the Services.
2. Gaining Access to and Using Services on Camspinchat
2.1 User Credentials Security
Access to your User Account and use of our Services is gained through various authentication methods including a unique login username and password combination, social network account integration (such as Facebook, Google, or Apple ID), or other authentication mechanisms that may be implemented from time to time (all of which may be referred to as "Credentials" or "User Credentials" hereafter). These credentials are used to authenticate and verify your identity as a genuine User for access to and use of our Services. You acknowledge and agree that you bear full and complete responsibility for maintaining the confidentiality and security of your User Credentials. You must not share your credentials with any third party or allow others to access your account. You should use strong, unique passwords and enable any additional security features we may offer, such as two-factor authentication. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Camspinchat will not be liable for any loss or damage arising from your failure to comply with these security obligations.
2.2 Account Responsibility
You are solely responsible for all activities that occur under your account and all actions performed using your User Credentials, whether or not you authorized such activities or actions. Without clear and convincing proof of fraud, security breach, or unauthorized access beyond your control, any and all actions performed using your User Credentials are conclusively presumed and considered to have been performed by you. This includes, but is not limited to, all messages sent, content uploaded, purchases made, agreements entered into, and any other interactions or transactions conducted through your account. You agree to accept full responsibility for all such activities and acknowledge that Camspinchat has no obligation to investigate or verify whether actions taken under your account were actually authorized by you. You will be liable for any losses, damages, or claims arising from the use of your account, regardless of whether such use was authorized by you, except where such losses result from our gross negligence or willful misconduct.
2.3 Personal Information Processing
The collection, processing, storage, and use of all personal information, personally identifiable information, and data provided to Camspinchat by Users of our Services, whether directly or indirectly, is governed exclusively by the terms, conditions, and practices described in detail in our Privacy Policy. By using our Services, you acknowledge that you have read and understood our Privacy Policy and consent to the collection and processing of your personal information as described therein. Our Privacy Policy explains what information we collect, how we use it, with whom we may share it, how long we retain it, and what rights you have regarding your personal information. The Privacy Policy is incorporated into and forms an integral part of this Agreement. We encourage you to review our Privacy Policy regularly as it may be updated from time to time to reflect changes in our data practices or legal requirements.
2.4 Internet Connection Responsibility
All issues, costs, fees, charges, data usage, and any other expenses or technical requirements associated with Internet connections, mobile data connection services, telecommunications services, Wi-Fi access, or any other means of connectivity required to access and use our Services are solely the responsibility of the individual User. Camspinchat makes no representations or warranties regarding the cost, availability, reliability, or quality of any Internet or data connection services. We strongly advise all Users to clarify and understand the costs and terms of any Internet or data connections with their service providers before using our Services, particularly if you are using mobile data or have limited data plans. You acknowledge that use of our video chat Services may consume significant amounts of data and bandwidth, and you agree to be responsible for any resulting charges or fees imposed by your Internet or mobile service provider. Camspinchat shall not be liable for any costs, charges, or fees incurred by you in connection with accessing or using our Services.
2.5 Service Availability Rights
Camspinchat expressly reserves the right, in its sole and absolute discretion, to temporarily or permanently discontinue, suspend, modify, or interrupt the operation of our Services, in whole or in part, at any time and for any reason without prior notice to Users. This includes, but is not limited to, suspensions or interruptions for purposes of performing maintenance, updates, upgrades, repairs, improvements, or modifications to our Services. We also reserve the right to alter, change, or modify one or more features, functionalities, or aspects of our Services for any reason, including technical reasons, security concerns, updates to comply with changing laws and regulations, legitimate objections from third parties, commercial or business reasons, strategic decisions, or service improvements and changes. We may also add new features, remove existing features, or change how features operate without prior notice. You acknowledge and agree that we have no obligation to maintain, support, or continue providing any particular feature or functionality, and we shall not be liable for any modifications, suspensions, or discontinuations of our Services.
2.6 Technical Issues Disclaimer
While we strive to provide reliable and uninterrupted Services, Camspinchat cannot guarantee continuous, uninterrupted, secure, or error-free operation of our Services. You acknowledge and agree that our Services may be temporarily or permanently unavailable, inaccessible, or non-functional at any time due to a variety of technical, maintenance, security, or other issues that may be beyond our reasonable control. Our Services are not immune from and may be affected by computer viruses, malware, hacker attacks, cyber attacks, distributed denial of service attacks, security breaches, software bugs, malfunctions or failures of hardware or software components, server failures, network connectivity issues, database errors, power outages, natural disasters, and other unexpected technical issues, circumstances, or events. We do not warrant that our Services will be free from such issues or that any defects will be corrected. The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
2.7 Technical Responsibility Limitation
To the maximum extent permitted by applicable law, Camspinchat, its affiliates, officers, directors, employees, agents, and service providers shall not be responsible or liable for any issues, problems, disruptions, interruptions, harm, loss, damage, or injury, including but not limited to material damage, data loss, financial loss, loss of business opportunities, or any other direct or indirect damages experienced by Users of our Services that arise from or relate to technical reasons, technical failures, Internet malfunctions, connectivity issues, service outages, software errors, hardware failures, security breaches, or any other technical or technological problems. This limitation applies regardless of whether we were advised of the possibility of such damages. However, we do commit to making commercially reasonable efforts and taking any feasible actions within our control to investigate, diagnose, repair, and resume correct functionality of our Services in a timely manner in the event of any technical difficulties, maintenance issues, or service disruptions. We will endeavor to minimize downtime and restore Services as quickly as reasonably possible under the circumstances.
3. User Contents
3.1 Copyright Ownership
You represent, warrant, and covenant that you are the sole and exclusive owner of all intellectual property rights, including but not limited to copyrights, trademarks, and other proprietary rights, in and to all materials, content, information, data, images, videos, audio recordings, text, messages, and any other content that you upload, transmit, display, or otherwise make available through our Services. You further represent and warrant that your content does not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity rights, or any other legal rights. You are solely responsible for ensuring that you have obtained all necessary permissions, licenses, consents, and authorizations required to upload and share your content through our Services. You agree to indemnify and hold Camspinchat harmless from any claims, damages, or losses arising from any breach of these representations and warranties.
3.2 Content License Grant
By uploading, submitting, transmitting, displaying, or otherwise making available any content through our Services, you hereby automatically and irrevocably grant to Camspinchat and its affiliates, licensees, and successors a worldwide, non-exclusive, royalty-free, fully paid-up, transferable, sublicensable, perpetual, and irrevocable license to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from, publicly perform, publicly display, and otherwise exploit such content in any manner, in any format or medium now known or hereafter developed, and for any purpose whatsoever. This broad license includes, without limitation, the right to modify, edit, or alter your content in any way and to use your content for commercial purposes, promotional purposes, marketing purposes, research and development, service improvement, or any other business purpose. This license shall continue even after you terminate your account or cease using our Services. You acknowledge that this license is necessary for us to provide and operate our Services effectively.
3.3 User Copyright Retention
Notwithstanding the license granted above, you retain ownership of all copyrights and other intellectual property rights in and to the original content that you create and upload to our Services. The license you grant to us does not transfer ownership of your content to Camspinchat; rather, it merely grants us permission to use your content as described in this Agreement. You remain free to use, license, or distribute your content to others, subject to the non-exclusive license you have granted to us. However, you acknowledge that once you share content through our Services, other users may view, download, screenshot, or otherwise capture that content, and you may not be able to fully control its subsequent use or distribution by others.
3.4 Platform Copyright
All intellectual property rights, including but not limited to copyrights, trademarks, service marks, trade names, patents, and trade secrets, in and to the Services themselves and all content, materials, graphics, logos, design elements, user interface, visual interfaces, photographs, trademarks, service marks, software, code, computer programs, text, and other information provided by Camspinchat through the Services (collectively, "Camspinchat Content") are and shall remain the exclusive property of Camspinchat and its licensors. The Camspinchat Content is protected by copyright, trademark, patent, trade secret, and other intellectual property laws and treaties. You acknowledge that the Services and Camspinchat Content contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by Camspinchat in writing, you agree not to reproduce, modify, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Camspinchat Content.
3.5 Content Usage Restrictions
You expressly agree and acknowledge that you shall not use, copy, reproduce, distribute, transmit, broadcast, display, sell, license, modify, adapt, create derivative works from, or otherwise exploit any content found in or through our Services that you do not own the intellectual property rights to. This prohibition includes, but is not limited to, content provided by Camspinchat (including all Camspinchat Content, branding, logos, and trademarks) and content uploaded or shared by other Users of our Services. You agree not to screenshot, record, download, or capture content from other users without their express permission. You also agree not to transfer, distribute, share, or make available any content from our Services to third parties or for use on other platforms or services. Violation of these content usage restrictions may result in immediate termination of your account and may expose you to civil and criminal liability. You agree to respect the intellectual property rights of Camspinchat and other users at all times.
3.6 Prohibited Content
You agree that you will not upload, post, transmit, display, or otherwise make available through our Services any content that: (a) violates our Terms of Service, Community Guidelines, Chat Rules, or any other policies or guidelines; (b) infringes or violates the intellectual property rights, privacy rights, publicity rights, or other legal rights of Camspinchat or any third party; (c) is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable; (d) depicts, promotes, or facilitates illegal activity, violence, self-harm, or harm to others; (e) contains or promotes hate speech, discrimination, or harassment based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic; (f) contains nudity, sexually explicit content, or sexual solicitation; (g) exploits or endangers minors in any way; (h) contains malware, viruses, or any malicious code; (i) impersonates any person or entity or misrepresents your affiliation with any person or entity; or (j) is spam, advertising, or promotional material not authorized by Camspinchat. We reserve the right to determine, in our sole discretion, what constitutes prohibited content.
3.7 Commercial Activity Prohibition
You expressly agree and acknowledge that you will not engage in any commercial activities or use our Services for any commercial purposes without the prior written consent of Camspinchat. This prohibition includes, but is not limited to: (a) promoting, advertising, marketing, or soliciting any products, services, or business opportunities; (b) offering any type of commercial services to other users; (c) conducting any form of commercial transaction or business activity through the Services; (d) recruiting or soliciting users for employment, business opportunities, or multilevel marketing schemes; (e) collecting user information for commercial purposes; (f) using the Services to generate revenue or profit in any way; or (g) using the Services to compete with or undermine Camspinchat's business. Our Services are intended solely for personal, non-commercial use for the purpose of meeting and communicating with other individuals. Any violation of this prohibition may result in immediate termination of your account and may expose you to legal liability.
3.8 Content Removal Rights
Camspinchat reserves the absolute and unconditional right, but not the obligation, to review, monitor, edit, refuse to post, remove, delete, or disable access to any content uploaded, posted, or shared by users through our Services at any time, for any reason or no reason, without prior notice or warning to the user who posted the content. This right includes the removal of content that we determine, in our sole and absolute discretion, violates these Terms of Service, our Community Guidelines, Chat Rules, applicable laws or regulations, or the intellectual property rights of third parties, or content that we deem to be otherwise objectionable, inappropriate, harmful, offensive, or inconsistent with the intended purpose of our Services. We may also remove content in response to complaints or reports from other users or third parties. The removal of content does not necessarily result in the termination or suspension of the user's account, although we reserve the right to take such actions as we deem appropriate. You acknowledge that Camspinchat has no obligation to pre-screen content and that we shall not be liable for any failure or delay in removing any content.
3.9 Privacy Policy Compliance
Camspinchat commits to conducting all aspects of its business operations, including the handling and processing of user content and personal information, in full compliance with the terms, conditions, obligations, and commitments set forth in our Privacy Policy at all times. Our Privacy Policy governs how we collect, use, store, share, and protect your personal information and content, and we take our privacy obligations seriously. We implement appropriate technical, administrative, and physical security measures designed to protect user data. However, you acknowledge that no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security. We will notify users in accordance with applicable laws in the event of any data breach that may compromise their personal information. By using our Services, you acknowledge that you have read and understood our Privacy Policy and consent to our data practices as described therein.
4. Paid Services
4.1 Paid Services Overview
Camspinchat offers certain premium paid services, features, and subscription plans to our Users, available through both our Website and Mobile Application. These paid services may include, but are not limited to, enhanced features, premium memberships, ad-free experiences, advanced matching capabilities, priority support, virtual gifts, and other premium functionalities designed to enhance your user experience. The availability, features, and pricing of paid services may vary depending on your geographic location, the platform you use (Website or Mobile Application), promotional offers, and other factors. We reserve the right to modify, add, remove, or discontinue any paid services at any time without prior notice. By purchasing any paid services, you agree to pay all applicable fees and charges, including any applicable taxes, in accordance with the payment terms presented to you at the time of purchase.
4.2 Automatic Subscription
Certain paid features may be offered through auto-renewing subscriptions. If you purchase or activate an auto-renewing subscription, you acknowledge and agree that your subscription will automatically renew at the end of each subscription period (whether weekly, monthly, annually, or otherwise) unless you cancel the subscription or turn off the auto-renewal feature at least 24 hours prior to the end of your current subscription period. You can manage your subscription settings and turn off auto-renewal through your account settings on the platform where you purchased the subscription (such as the Apple App Store, Google Play Store, or our Website). It is your responsibility to cancel your subscription if you do not want it to auto-renew. If you do not cancel your subscription before the auto-renewal date, you authorize us or our third-party payment processors to charge your payment method for the renewal period at the then-current subscription rate.
4.3 Subscription Billing
For auto-renewing subscriptions, your account will be charged for the renewal subscription period within the 24 hours prior to the end of the current subscription period. The renewal will be charged at the same subscription rate as your current period unless we have notified you of a price change in accordance with applicable laws and platform requirements. If you turn off auto-renewal or cancel your subscription during the 24-hour period immediately before your current subscription period ends, the cancellation or deactivation of auto-renewal will not take effect until the end of the next subscription period (the one for which you have already been charged). You will retain access to the paid features for the duration of the subscription period you have paid for, even if you cancel before the period ends. By subscribing, you authorize Camspinchat and/or our third-party payment processors to store your payment information and charge your payment method on a recurring basis until you cancel your subscription.
4.4 Non-Transferable Services
All subscriptions, paid services, premium features, virtual goods, credits, coins, and any other paid items or benefits obtained through our Services are personal to your account and are non-transferable, non-assignable, and non-refundable except as required by applicable law. You may not sell, trade, transfer, gift, or otherwise provide access to your paid services or premium account features to any third party. Any attempt to transfer or sell subscriptions or paid services may result in the immediate termination of your account and forfeiture of all paid services without refund. Premium features and subscriptions are licensed, not sold, and you acquire no ownership rights in any paid services or premium features. Upon termination of your account or subscription, you will lose access to all paid features and any virtual goods or credits associated with your account.
4.5 Additional Paid Features
In addition to subscription-based services, we may offer various one-time or consumable paid features, items, or services that can be purchased on an individual, non-recurring basis. These may include, without limitation: the ability to remove a temporary ban or suspension before its natural expiry, virtual gifts or items to send to other users, profile boosts or enhanced visibility, access to advanced filters or search features, the ability to view who has viewed your profile, rewind or undo features, unlimited messaging capabilities, or other premium functionalities. These additional paid features may be purchased via in-app purchases through your mobile device's app store (such as Apple's App Store or Google Play Store) when using our Mobile Application, or via a variety of payment methods including credit cards, debit cards, PayPal, or other payment processors when using our Website. The availability of specific payment methods may vary by region.
4.6 Final Payment Policy
Except as required by applicable law or as expressly stated otherwise in writing by Camspinchat, all payments for paid services, subscriptions, premium features, virtual goods, and any other purchases made through our Services are final, non-refundable, and non-exchangeable. You will not receive a refund or credit for partially used subscription periods, unused virtual goods or credits, or for subscriptions or paid services for which you did not cancel auto-renewal in accordance with the cancellation requirements. In the event that we terminate or suspend your account for violation of these Terms of Service or our Community Guidelines, you will not be entitled to any refund of fees paid for subscriptions or paid services. However, if you believe you have been wrongly charged or if you have other billing concerns, please contact our customer support team, and we will review your request in accordance with applicable laws and the policies of the relevant app store or payment processor.
4.7 Pricing Determination
The pricing for paid services, subscriptions, and premium features is determined by Camspinchat in its sole discretion and may be based on a variety of factors including, but not limited to: current promotional campaigns and special offers, loyalty rewards and user activity levels, introductory pricing for new users, bulk purchase discounts, regional pricing variations based on geographic location and local market conditions, age-based pricing where permitted by law, subscription duration (weekly, monthly, annual, etc.), bundled services and package deals, competitive market analysis, and strategic business considerations. Prices may vary between different platforms (Website vs. Mobile Application) and may be different in different countries or regions. We reserve the right to change our pricing at any time, but price changes will not affect active subscriptions until they renew. Any promotional or discounted pricing is subject to change without notice and may only be available for a limited time or to specific user segments. We may also conduct pricing experiments and testing, which may result in different users seeing different prices for the same services.
5. Termination of Access
5.1 User Termination Rights
You have the right to terminate your use of our Services at any time for any reason without prior notice to Camspinchat. You may delete your user profile and all associated data through the account settings within our Services. You may uninstall the Mobile Application from your device at any time. You may cancel any active subscription or turn off auto-renewal through the subscription management settings on the platform where you purchased the subscription (your account settings in the App Store, Google Play Store, or our Website, as applicable). Deletion of your account will result in the permanent removal of your profile, content, and personal information from our active systems, subject to the retention periods described in our Privacy Policy and as required by applicable laws. Please note that canceling a subscription will stop future charges but will not provide a refund for the current subscription period, and you will retain access to paid features until the end of the period you have already paid for.
5.2 Violation Consequences
Any User who engages in conduct that violates the Chat Rules, Community Guidelines, behavioral standards, or acceptable use policies while using our Services, who breaches any term or condition of this User Agreement, or who provides, distributes, uploads, or shares prohibited content as defined in Section 3 of this Agreement, may have their access to our Services suspended, limited, restricted, or permanently terminated without any prior notice, warning, or obligation on the part of Camspinchat (whether financial, refund-related, or otherwise). Violations that may result in suspension or termination include, but are not limited to: uploading prohibited content, harassment or abusive behavior toward other users, impersonation or fraudulent activity, spamming or commercial solicitation, underage use, sharing of sexually explicit content, hate speech or discriminatory conduct, threats or promotion of violence, attempted hacking or security violations, use of automated tools or bots, creation of multiple accounts to evade bans, or any other conduct that we determine, in our sole discretion, is harmful to our community or inconsistent with the purpose of our Services.
5.3 Enforcement Rights
Camspinchat reserves the absolute right, exercisable in our sole and unfettered discretion, to suspend, limit, restrict, or permanently terminate any User's account, registration, or access to our Services at any time, for any reason or no reason, with or without prior notice or warning. We also reserve the right to employ and utilize any software-based, technical, legal, investigative, or other means available to us to enforce these Terms, protect our Services and community, prevent abuse, investigate violations, identify violators, and ensure compliance with these Terms and applicable laws. Such enforcement measures may include, without limitation: blocking specific IP addresses or ranges of IP addresses, implementing device bans or hardware identifier blocks, terminating accounts and deleting associated data, rate limiting or throttling access, deploying automated detection and filtering systems, cooperating with law enforcement authorities, pursuing legal action against violators, reporting illegal activity to appropriate authorities, and sharing information about violations with third-party service providers or other platforms to prevent cross-platform abuse.
5.4 Notification Policy
While Camspinchat will generally attempt to notify Users via email, in-app notification, or other available means about account suspensions, restrictions, or terminations when practicable and appropriate, we are under no legal or contractual obligation to provide such notice or explanation. In some circumstances, particularly involving serious violations, legal requirements, or security concerns, we may terminate or suspend accounts immediately without advance notice. We reserve the right to withhold specific details about the reasons for suspension or termination if we determine that disclosure could compromise our security measures, investigation procedures, or enforcement capabilities, or if disclosure is prohibited by law or legal process. You acknowledge that we have no obligation to provide an opportunity to cure violations before taking enforcement action, although we may choose to do so in our discretion.
5.5 Subscription Continuity
You expressly acknowledge and agree that in the event your access to Services is limited, restricted, suspended, or terminated due to a violation of the Chat Rules, Community Guidelines, Terms of Service, or any other policy violation, your subscription and the automatic renewal of your subscription shall nevertheless remain active, valid, and in full force and effect, and charges will continue to be processed according to your subscription terms until such time as you affirmatively cancel the subscription through the appropriate subscription management interface on the platform where you purchased it. Suspension or termination of your account for violations does not automatically cancel your subscription, and you will not be entitled to a refund of subscription fees for any period during which your access is restricted or terminated due to your violations. It is your sole responsibility to cancel your subscription if you no longer wish to be charged, even if your account has been suspended or terminated.
5.6 Survival of Terms
You acknowledge and agree that any and all provisions of this Agreement related to or regarding limitation of liability, disclaimers of warranties, indemnification obligations, intellectual property rights, dispute resolution procedures, arbitration clauses, class action waivers, governing law, payment obligations for services already rendered, and any other provisions that by their nature should survive termination, shall continue in full force and effect and shall survive and remain binding upon you following any termination of this Agreement, termination or suspension of your account, termination or cancellation of your subscription to our Services, or cessation of your use of our Services for any reason. These surviving provisions remain enforceable and continue to govern the relationship between you and Camspinchat with respect to matters that arose during the term of your use of the Services.
6. Abuses and Complaints
6.1 Reporting Violations
If you encounter, experience, or become aware of any incidents of abuse, harassment, inappropriate behavior, violations of our Chat Rules or Community Guidelines, breaches of these Terms of Service, illegal activity, or improper use of your copyright, trademark, or other intellectual property rights by other Users while using our Services, we strongly encourage you to report such incidents to us immediately. Reports may be submitted through various channels including in-app reporting features, the report button or link available during or after video chats, email addresses designated for abuse reports, contact forms accessible through our Website or Mobile Application, or other reporting mechanisms and methods of contact as presented and made available within our Services. When reporting violations, please provide as much detail as possible, including the username or profile information of the alleged violator, the date and time of the incident, a description of the violation, screenshots or other evidence if available, and any other relevant information that may assist us in investigating the report. All reports are reviewed by our moderation team, and we take appropriate action in accordance with our policies and applicable laws.
6.2 Dispute Resolution Violations
Users who attempt to resolve disputes, disagreements, conflicts, or grievances with other Users of our Services through means that violate our Chat Rules, Community Guidelines, Terms of Service, or Privacy Policy, including but not limited to engaging in retaliatory harassment, posting prohibited content in retaliation, making threats, sharing another user's personal information without consent (doxing), engaging in defamation or libel, or taking any illegal actions such as making inappropriate, threatening, harassing, or abusive remarks to other Users, are themselves in violation of our Terms and are liable to have their own access to our Services immediately limited, restricted, suspended, or permanently terminated on a temporary or permanent basis. We do not tolerate vigilante justice or self-help remedies that violate our rules. If you have a dispute with another user, you must report it through proper channels and allow us to handle the situation. Taking matters into your own hands by violating our Terms will result in enforcement action against you, regardless of whether the other user also violated our Terms. We reserve the right to terminate the accounts of all parties involved in a dispute if both parties engaged in violations.
7. Limitation of Liability
7.1 User Action Disclaimer
Camspinchat, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, partners, licensors, and service providers expressly disclaim and shall not be held responsible or liable for any actions, conduct, behavior, content, communications, or activities undertaken, performed, or engaged in by any Users while accessing or using our Services, or for any content, information, materials, messages, or communications provided, uploaded, transmitted, shared, or distributed by Users through our Services. You acknowledge and agree that Camspinchat does not pre-screen user content, does not endorse any user content or user conduct, and is not responsible for monitoring or supervising user interactions. You use our Services and interact with other users at your own risk. Camspinchat is not a party to any disputes or interactions between users and shall not be involved in or responsible for resolving such disputes. You release Camspinchat from any and all claims, demands, and damages arising out of or in any way connected with your interactions with other users.
7.2 Comprehensive Liability Limitation
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAMSPINCHAT, ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR AND EXPRESSLY DISCLAIM ANY AND ALL LIABILITY RESULTING FROM, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH YOUR ACCESS TO OR USE OF OUR SERVICES. This comprehensive limitation of liability includes, but is not limited to, liability resulting from or relating to: lawsuits, litigation, legal claims, or legal proceedings; civil or criminal penalties; claims for damages of any kind; contractual or tort obligations; expenses, costs, or fees of any nature and type including legal fees; direct, indirect, incidental, consequential, special, punitive, or exemplary damages or losses; losses caused by negligence (whether ours or that of others); service interruptions or service unavailability; loss, corruption, or deletion of data or content; damage to hardware, software, or devices due to viruses, malware, hacking, or cyber attacks; loss of income, revenue, profits, or business opportunities; loss of goodwill or reputation; waste of time or resources; breaches of contract by third parties; third party claims or demands; personal injury, emotional distress, or pain and suffering; or any other losses, damages, claims, or liabilities of any kind whatsoever, whether foreseeable or unforeseeable, and whether or not we have been advised of the possibility of such damages.
7.3 Technical Issues Coverage
The comprehensive limitation of liability set forth above specifically covers and includes, but is in no way limited to, any damages, losses, injuries, or problems arising from or relating to: the transmission, downloading, or receipt of any software, applications, scripts, code, malware, viruses, trojan horses, worms, ransomware, spyware, or any other malicious or harmful code or content that may damage, interfere with, intercept, or expropriate your hardware, software, devices, systems, or data; malfunctions, defects, errors, bugs, or failures of any mechanical, electrical, electronic, or digital hardware or equipment; malfunctions, defects, errors, bugs, or failures of software, applications, programs, code, or systems; problems with, failures of, or interruptions to communication lines, networks, telecommunications services, or internet connectivity; connection issues, latency, bandwidth limitations, or data transmission problems; unauthorized access to your accounts, devices, systems, or data; hacking, phishing, social engineering, or other cyber attacks; theft, stealing, or misappropriation of data, content, funds, or property; identity theft or fraud; personal injury, bodily harm, or emotional distress; property damage or loss; errors, mistakes, or negligence by operators, users, or third parties; labor strikes, work stoppages, or labor disputes; acts of God, force majeure events, natural disasters, wars, terrorism, pandemics, or government actions; or any other causes beyond our reasonable control.
7.4 User Indemnification
You agree to indemnify, defend, and hold harmless Camspinchat, its parent companies, subsidiaries, affiliates, successors, assigns, officers, directors, shareholders, employees, agents, representatives, partners, licensors, service providers, and contractors (collectively, the "Indemnified Parties") from and against any and all third-party claims, demands, actions, lawsuits, proceedings, investigations, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees and legal costs), fines, penalties, settlements, and judgments of any kind or nature whatsoever that arise out of, result from, or relate in any way to: (a) your access to or use of our Services; (b) your violation of these Terms of Service or any applicable laws, regulations, or third-party rights; (c) your content or any content you upload, post, transmit, or share through our Services; (d) your interactions, communications, or conduct with other users; (e) your breach of any representations, warranties, or obligations set forth in this Agreement; (f) any personal actions, conduct, or behavior engaged in by you while using our Services; or (g) any negligence, willful misconduct, or illegal activity on your part. You agree to cooperate fully with us in the defense of any such claims and not to settle any such claims without our prior written consent.
8. Amendments
8.1 Amendment Rights
Camspinchat expressly reserves the right, in its sole and absolute discretion and without any obligation to provide prior notification or advance notice to you or any other user, to amend, modify, revise, update, change, supplement, or replace these Terms of Service, our Chat Rules and Community Guidelines, our Privacy Policy, and any other policies, agreements, or documents governing your use of our Services, at any time and for any reason. Such amendments may be made to reflect changes in applicable laws or regulations, to address new features or functionalities, to clarify existing provisions, to respond to user feedback or concerns, to address security or safety issues, to implement business decisions, or for any other reason we deem appropriate. We may make minor changes without notice, but for material changes that adversely affect your rights, we will make reasonable efforts to notify you through our Services, via email to the address associated with your account, or through other appropriate means, where required by applicable law.
8.2 Document Publication
The most current, recent, and up-to-date versions and copies of these Terms of Service, our Privacy Policy, our Community Guidelines, Chat Rules, and all other governing documents and policies are published and made available on our Website at all times. You can access these documents through links typically found in the footer of our Website, in the settings or legal section of our Mobile Application, or through other prominent locations within our Services. It is your responsibility to review these documents periodically to stay informed of any changes. We may also maintain an archive of previous versions of these documents for reference purposes, but the version currently published on our Website supersedes all prior versions and is the version currently in effect and binding upon all users.
8.3 Amendment Effective Date
Unless otherwise specified or required by applicable law, any amendments, modifications, revisions, or changes to these Terms of Service, Privacy Policy, Community Guidelines, or other governing documents shall become active, effective, valid, and binding from the moment the amended text is published and updated on the respective page on our Website or Mobile Application. In some cases, we may specify a delayed effective date for certain amendments, particularly for material changes that require advance notice under applicable laws or app store requirements. If a specific starting date or effective date for an amendment is indicated or specified on our Website or in a notification to users, then the amendment shall become effective on that designated date. You can determine whether the Terms have been updated by checking the "Last Updated" date displayed at the top or bottom of these Terms of Service.
8.4 User Notification
While in some instances and for certain types of material amendments we may make reasonable efforts to notify Users of significant amendments to these Terms, our Privacy Policy, or other governing documents through email notifications, in-app notifications, pop-up notices, banners, or other communication methods, you acknowledge and agree that Camspinchat is under no legal obligation to provide such individual notification to users. It remains your sole responsibility as a user to regularly check and review the respective pages where these documents are published for any updates, changes, or amendments. You should review these Terms, the Privacy Policy, and other governing documents periodically, and especially before engaging in certain activities such as making purchases, subscribing to paid services, or providing sensitive information. Your failure to review these documents and stay informed of changes does not excuse you from compliance with the amended terms.
8.5 Continued Use Agreement
If you disagree with, object to, or do not accept any terms, conditions, provisions, or amendments outlined in this Agreement or any other governing documents, your sole and exclusive remedy is to immediately stop using our Services with immediate effect and, if applicable, to delete your account and uninstall our Mobile Application. Your continued access to or use of our Services following the publication of any amendments, modifications, or changes to these Terms of Service or other governing documents constitutes your binding acceptance of all such changes and your agreement to be bound by the amended terms of this Agreement and any modified policies. By continuing to use our Services after amendments become effective, you affirmatively agree to all changes and waive any right to claim that you were not adequately notified of such changes or that you do not agree to such changes. If you do not agree with any amendments, you must immediately cease using our Services.
9. Child Safety Policy
9.1 Age Restriction and Verification
You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater, to access, register for, or use Camspinchat Services. This age requirement is absolute and non-negotiable, and it applies to all features, functionalities, and aspects of our platform without exception. Any attempts, efforts, or actions to falsify, misrepresent, conceal, or lie about your age, date of birth, or identity in order to gain unauthorized access to our platform are strictly forbidden, absolutely prohibited, and constitute a serious violation of these Terms of Service. Such violations will lead to immediate and severe consequences including instant account suspension, permanent account removal and termination, potential reporting to law enforcement authorities, and possible legal action. Camspinchat employs, implements, and utilizes sophisticated, advanced, and continuously updated automated detection systems, artificial intelligence algorithms, machine learning models, and manual human review processes to detect, identify, prevent, and respond to underage activity, age falsification attempts, and any content or behavior related to Child Sexual Exploitation and Abuse (CSEA). Any attempts to circumvent, bypass, defeat, interfere with, or undermine these age verification and child safety detection systems are strictly prohibited and will result in immediate permanent ban from our Services and potential reporting to appropriate authorities. We take the safety of minors extremely seriously and have zero tolerance for any violations of our age restrictions or child safety policies.
9.2 Prohibited Activities - CSEA and Sexualization of Minors
Camspinchat has an absolute zero-tolerance policy for Child Sexual Abuse and Exploitation (CSEA) and any form of sexualization of minors. The following activities are strictly prohibited and will result in immediate permanent account termination, preservation of evidence, and mandatory reporting to the National Center for Missing and Exploited Children (NCMEC), law enforcement agencies, and other relevant authorities as required by applicable laws: (1) Creating, uploading, sharing, transmitting, distributing, requesting, soliciting, accessing, or possessing any content that involves, depicts, promotes, encourages, or facilitates child sexual abuse, child exploitation, or any form of sexual activity involving minors; (2) Sharing, distributing, producing, or creating any content featuring the sexual fetishization of minors, including but not limited to explicit sexual discussions involving or about minors, sexualized role-playing scenarios involving minor characters or personas, content depicting minors wearing sexualized clothing or in sexualized poses, sexual or romantic solicitation of minors, grooming behavior, or any other content that sexualizes individuals under 18 years of age; (3) Sharing, creating, distributing, or possessing any depictions of child nudity, partial nudity, or sexualization of minors in any form, format, or medium whatsoever, including but not limited to photographs, videos, live streams, artistic works, drawings, illustrations, animations, cartoons, computer-generated imagery (CGI), deepfakes, or any other visual or textual representations; and (4) Any grooming behavior, predatory conduct, sexual solicitation, inappropriate communication, or attempts to establish inappropriate relationships with individuals who are or appear to be minors. These prohibitions are comprehensive and apply regardless of the claimed artistic, educational, or other purported purpose of the content.
9.3 Harmful or Dangerous Acts Involving Minors
In addition to prohibitions on sexual content involving minors, Camspinchat strictly prohibits any content, communications, or conduct that threatens, endangers, harms, exploits, or puts at risk the physical, emotional, psychological, or mental well-being, safety, or welfare of minors. Prohibited activities in this category include, but are not limited to: (1) Threatening, encouraging, promoting, glorifying, depicting, or committing any form of physical violence, abuse, assault, corporal punishment, or bodily harm against minors; (2) Psychological abuse, emotional abuse, verbal abuse, intimidation, harassment, bullying, coercion, manipulation, gaslighting, or any other form of mental or emotional harm directed at or involving minors; (3) Depicting, encouraging, promoting, glorifying, instructing, or facilitating dangerous activities, challenges, stunts, dares, games, or behaviors involving minors that could result in physical injury, psychological harm, or death; (4) Promoting, showing, depicting, encouraging, or engaging in neglect, abandonment, deprivation, or failure to provide proper care for minors; (5) Promoting, facilitating, depicting, encouraging, or engaging in trafficking of minors, exploitation of minors for labor or other purposes, sale or trade of minors, or any other form of human trafficking involving individuals under 18 years of age; and (6) Any other conduct, content, or communication that endangers, harms, exploits, or threatens the safety, welfare, or well-being of minors in any way.
9.4 Prohibition of Underage Presence on Platform
Minors (individuals under 18 years of age or under the age of majority in their jurisdiction) are absolutely and strictly prohibited from appearing in, being featured in, being visible in, or being present in any live streams, video chats, recorded videos, photographs, images, profile pictures, thumbnails, or any other type of content, material, or communication created, shared, uploaded, transmitted, or distributed through our Services, regardless of context, purpose, or circumstances. This prohibition is comprehensive and applies even if the minor is fully clothed, engaged in non-sexual activities, accompanied by parents or guardians, or appearing incidentally or in the background. The following specific activities are strictly forbidden: (1) Minors appearing in live video streams, video chats, or any real-time video communications on the platform; (2) Creating, managing, operating, or maintaining user accounts on behalf of minors or allowing minors to use your account; (3) Featuring minors in any content uploaded to or shared through our Services; (4) Attempting to falsify, misrepresent, or conceal the age of yourself or others to gain access to the platform or to allow minors to access the platform; (5) Assisting, enabling, facilitating, or encouraging minors to access or use our Services in any manner; and (6) Providing access credentials, account information, or devices to minors for the purpose of accessing our Services. Parents, guardians, and adult users are responsible for ensuring that minors do not access or appear on our platform.
9.5 Reporting Mechanism and Cooperation with Authorities
Camspinchat is committed to protecting children and cooperating fully with law enforcement agencies, child protection organizations, and regulatory authorities in the investigation and prosecution of crimes against children. All incidents, reports, content, or activities involving, related to, or potentially involving child sexual abuse, child exploitation, endangerment of minors, or any other violations of our Child Safety Policy will be taken with utmost seriousness and will be promptly reported to the National Center for Missing and Exploited Children (NCMEC) through the CyberTipline as required by federal law, as well as to other relevant authorities, law enforcement agencies, regulatory bodies, and child protection organizations as required or permitted by applicable laws and regulations in various jurisdictions. We preserve all evidence related to such incidents, including content, communications, account information, IP addresses, device information, and any other relevant data, and provide this information to law enforcement and other authorities upon lawful request or as required by law. Users can and should report any potential violations of our Child Safety Policy, suspected child abuse, underage users, inappropriate content involving minors, or any other child safety concerns using the in-app reporting function available within our Services, or by contacting us directly via email. When reporting violations, please provide as much detail as possible, including usernames, descriptions of the violation, screenshots or evidence (without sharing illegal content), dates and times, and any other relevant information. All reports are reviewed by our Trust and Safety team and appropriate action is taken, which may include content removal, account termination, and reporting to authorities.
9.6 Prohibited Users and Background Restrictions
Individuals who have been convicted of, pleaded guilty to, pleaded no contest to, or are registered sex offenders for crimes against children, minors, or vulnerable persons, including but not limited to sexual assault, sexual abuse, molestation, rape, statutory rape, child pornography offenses, child exploitation, physical abuse of minors, neglect of minors, endangerment of minors, trafficking of minors, kidnapping of minors, or any other crimes involving minor victims, are strictly and permanently prohibited from creating accounts, accessing, using, or participating in Camspinchat Services in any manner whatsoever. By creating an account and using our Services, you represent, warrant, and certify that you are not subject to any such prohibitions, that you have not been convicted of any crimes against children or minors, that you are not required to register as a sex offender in any jurisdiction, and that you are not legally prohibited from accessing online services or communicating with minors. Violation of these prohibitions may constitute a criminal offense and will be reported to appropriate law enforcement authorities. We may conduct background checks, verification processes, or screening procedures where permitted by law, and we reserve the right to terminate accounts of users who are discovered to be in violation of these prohibitions. Users who become aware of prohibited individuals using our Services should report such individuals to us immediately.
9.7 Enforcement Measures and Transparency
All violations of this Child Safety Policy, regardless of severity, intent, or circumstances, will result in immediate, swift, and decisive account penalties and enforcement actions. Depending on the nature, severity, frequency, and circumstances of the violation, enforcement measures may include but are not limited to: immediate permanent account termination and ban from all Camspinchat Services without warning, prior notice, or opportunity to cure; permanent device bans preventing access from specific devices; IP address blocking and network-level restrictions; removal of all content posted by the violating user; forfeiture of any paid subscriptions or premium features without refund; preservation and collection of all evidence related to the violation; mandatory reporting to NCMEC, law enforcement agencies, and other relevant authorities; cooperation with law enforcement investigations, including providing user information, communications, content, IP addresses, payment information, and any other relevant data upon lawful request or as required by law; pursuit of civil legal action for damages; referral for criminal prosecution where appropriate; and inclusion in databases or information-sharing systems designed to prevent reoffending across multiple platforms. Camspinchat may, at its sole discretion, cooperate and coordinate with other online platforms, technology companies, child safety organizations, and law enforcement agencies during investigations and enforcement actions related to child safety violations. We are committed to transparency in our child safety efforts while balancing privacy considerations and the integrity of investigations.
9.8 User Education and Safety Resources
Camspinchat is committed to educating our user community about child safety, online safety best practices, recognizing and reporting abuse, and maintaining a safe environment for all users. We educate users on child safety and promote awareness through multiple methods including: prominently displaying this Child Safety Policy on our platform and making it easily accessible to all users; requiring users to acknowledge and agree to our child safety policies during account registration and at regular intervals; providing educational prompts, reminders, warnings, and informational messages during content creation, sharing, and live streaming to help users understand and avoid risky situations, inappropriate content, and policy violations; offering safety tips, guidelines, and best practices through our help center, FAQ resources, and educational materials; implementing real-time warnings and interventions when potentially problematic behavior or content is detected; and partnering with child safety organizations, experts, and advocacy groups to develop and improve our safety education initiatives. We encourage all users to familiarize themselves with child safety issues, to exercise caution and good judgment in their interactions on our platform, to report any suspicious or inappropriate behavior, and to help us maintain a safe community for all users.

For users in North America (United States, Canada, Mexico), we recommend contacting the National Center for Missing & Exploited Children (NCMEC) at CyberTipline.org or 1-800-THE-LOST for reporting online child exploitation and missing children. For users in Australia and New Zealand, contact the Australian Centre to Counter Child Exploitation or Netsafe New Zealand. For users in Europe and the United Kingdom, utilize law enforcement reporting channels for child sexual coercion, exploitation, and extortion through organizations such as Internet Watch Foundation (IWF), CEOP (Child Exploitation and Online Protection), and local police authorities. For users in South America, Asia, Africa, and other locales, contact the International Centre for Missing & Exploited Children (ICMEC) global hotline at ICMEC.org to be directed to appropriate local resources and reporting mechanisms. In all cases, if you witness or suspect child abuse occurring in the physical world, contact your local police, emergency services, or child protective services immediately. These external resources operate independently of Camspinchat and provide critical services for child protection and victim assistance.
